These Terms of Service apply to purchases from Buy With Evidence, operated by Fidum Pty Ltd.
By accessing this website, placing an order, downloading a product or using our digital materials, you agree to these terms.
1. About Buy With Evidence
Buy With Evidence sells digital automotive decision-support products, including PDF toolkits, checklists, worksheets, buyer guides and related downloadable files.
Our products are designed to help customers organise information, record observations, ask better questions and make more structured decisions before paying for a vehicle, repair, inspection or related service.
2. Digital products only
Our products are supplied as downloadable digital files. No physical product is shipped.
After successful payment, download access is provided electronically through the checkout/order status page and/or email.
For best results, customers should download the ZIP file to a desktop or laptop, unzip the folder, and open fillable PDF files in a compatible desktop PDF viewer such as Adobe Acrobat Reader. Browser and mobile PDF viewers may not support every form, field or calculation feature consistently.
3. Product scope
Our products provide general educational information, structured checklists, worksheets and decision-support material.
Our products do not:
- diagnose vehicles;
- guarantee vehicle condition;
- replace a qualified pre-purchase inspection;
- replace a qualified mechanic, auto electrician, EV/hybrid technician, insurer, accountant, finance provider or lawyer;
- provide legal advice;
- verify current state or territory legal requirements for you;
- guarantee that a vehicle, seller, dealer, repair, inspection, finance product or transaction is safe, suitable or risk-free.
Customers remain responsible for checking current official sources, obtaining qualified advice where needed, and making their own purchase or payment decisions.
4. Beta Edition products
Beta Edition products are limited paid market-test releases.
A Beta Edition product may be updated after release based on customer feedback, corrections, usability improvements or product development.
Buying a Beta Edition product means you understand that:
- it is being released for controlled market testing;
- future versions may be changed, expanded or improved;
- the beta price may differ from future public-release pricing;
- customer feedback may be used to improve future versions.
5. State and territory requirements
State and territory rules, transfer processes, roadworthy or safety-certificate requirements, cooling-off rights, statutory warranty rules and regulator guidance may change.
Our Beta Edition materials do not verify current state or territory legal requirements for each customer.
Before signing, paying, collecting a vehicle, transferring registration or relying on a legal or administrative requirement, customers should check the current requirements directly with the relevant official regulator.
6. Accuracy and updates
We take reasonable care when preparing and updating our products. However, vehicle rules, official guidance, manufacturer information, technology, insurance availability, EV/hybrid support, pricing and market conditions can change.
We may update, replace or withdraw products at any time.
We do not promise that every statement will remain current after the stated review or version date.
7. Customer responsibility
Customers are responsible for:
- reading the product description before purchase;
- checking that the product suits their intended use;
- using a compatible device and PDF viewer;
- saving their downloaded files;
- checking official sources where instructed;
- obtaining qualified inspections or professional advice where appropriate;
- making their own purchase, repair, payment or walk-away decisions.
8. Licence to use digital products
When you buy a product, you receive a personal, non-exclusive, non-transferable licence to use the product for your own private decision-making or internal business use.
You must not:
- resell the files;
- upload the files to public websites or file-sharing services;
- share the files as a free download;
- copy the product to create a competing product;
- remove branding, version details or notices;
- claim the product as your own work.
Reasonable internal use is allowed where the product has been purchased for business use, such as by an owner-driver, small fleet operator or workshop using the product internally.
9. Payments
Prices are shown in Australian dollars unless stated otherwise.
Payment must be successfully completed before digital files are supplied.
We may change prices at any time. A later price change does not change the price of an order that has already been accepted.
10. Refunds and consumer rights
Refunds and remedies are handled under our Return and Refund Policy.
Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
11. No misuse of the website or products
You must not use this website, checkout, digital delivery system or product files in a way that is unlawful, fraudulent, abusive, harmful, misleading or intended to interfere with our business, systems, customers or intellectual property.
12. Limitation of liability
To the maximum extent permitted by law, Buy With Evidence and Fidum Pty Ltd are not liable for loss arising from:
- a customer choosing to buy, not buy, inspect, not inspect, repair, not repair or pay for a vehicle;
- reliance on seller statements, dealer statements, inspection results or third-party information;
- state, territory, manufacturer, insurer, finance provider or regulator changes;
- incompatible PDF software, devices or customer systems;
- customer failure to check official sources or obtain qualified advice where appropriate.
This clause does not limit any rights or remedies that cannot legally be excluded under Australian Consumer Law.
13. Third-party links and sources
Our products and website may refer to third-party websites, official regulators, service providers, manufacturers, insurers, payment providers or other external resources.
Those third parties are not controlled by us. We are not responsible for their content, availability, accuracy, pricing, decisions or updates.
14. Intellectual property
All product content, structure, wording, checklists, worksheets, design elements, branding and downloadable files remain the intellectual property of Buy With Evidence, Fidum Pty Ltd or their licensors.
Purchasing a product does not transfer ownership of the intellectual property.
15. Changes to these terms
We may update these Terms of Service from time to time. The updated version will apply from the date it is published on this website.
16. Governing law
These terms are governed by the laws of New South Wales, Australia, subject to any rights you may have under Australian Consumer Law or other applicable law.
